McLane Middleton attorney Andrea J. Schweitzer will be presenting on “Dispute Avoidance in Trusts & Estates” as part of the New Hampshire Bar Association’s Learn@Lunch webcast series on May 16, 2022 at 12:00 p.m. ET.
The program will provide practice pointers for estate planning attorneys seeking to avoid disputes that commonly arise in the context of trust and estate administrations. Topics will include assessing and documenting testamentary capacity (including dealing with clients with diminished capacity), communicating with clients during the estate planning process, dealing with family members who get involved in the estate planning process, properly handling document executions, and tips and techniques for drafting (no-contest clauses, accounting provisions, etc.) designed to reduce the prospect of disputes after the client dies. There will also be discussion about the role of drafting attorneys in probate litigation, including as key fact witnesses.
AJ is an associate in McLane Middleton’s Litigation Department where she assists clients in a variety of matters. Her practice primarily focuses on probate litigation, including representation of clients in:
- Trust and will contests involving claims of incapacity and undue influence;
- Breach of fiduciary duty, self-dealing, commingling, and unjust enrichment claims against attorneys-in-fact, trustees, and other fiduciaries;
- Accounting actions against fiduciaries, including attorneys-in-fact and trustees; and,
- Partition actions.
